1. Acceptance of Terms

By accessing, browsing, or using KenkoWear Hub's website, mobile applications, or any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and all applicable laws and regulations. These terms constitute a legally binding agreement between you and KenkoWear Hub.

If you do not agree with any part of these terms, you are prohibited from using our services and should discontinue access immediately. These terms apply to all users of our platform, including customers, corporate clients, visitors, and any other individuals who access our services in any capacity.

We reserve the right to refuse service to anyone for any reason at any time, subject to applicable laws and regulations. Your continued use of our services following any modifications to these terms constitutes acceptance of those changes.

2. Description of Services

KenkoWear Hub operates as a comprehensive marketplace and service provider for wearable fitness technology, offering the following services:

  • Marketplace Services: Sale and leasing of new and certified pre-owned smartwatches, fitness bands, and related accessories from leading manufacturers
  • Flexible Leasing Programs: Monthly payment plans with options to upgrade, purchase, or return devices at any time during the lease period
  • Certified Pre-owned Program: Thoroughly tested and certified pre-owned devices with warranties and significant cost savings compared to new devices
  • Repair and Maintenance Services: Comprehensive device repair, maintenance, and technical support through our network of certified technicians across Japan
  • Corporate Wellness Solutions: B2B programs designed for organizations to implement employee wellness initiatives using wearable technology
  • Health App Integration Platform: Connectivity services enabling seamless integration with popular health and fitness applications
  • Trade-in and Upgrade Services: Device trade-in programs allowing customers to upgrade to newer models with credit toward new purchases or leases
  • Customer Support Services: Technical support, account management, and customer service through multiple communication channels
  • Data Analytics Services: Privacy-first health and fitness analytics for individual users and corporate wellness programs

3. Account Registration and Eligibility

Eligibility Requirements

To create an account and use our services, you must meet the following requirements:

  • Be at least 18 years of age or have reached the age of majority in your jurisdiction
  • Be a legal resident of Japan with a valid Japanese address
  • Provide accurate, complete, and current registration information
  • Have the legal capacity and authority to enter into binding agreements
  • Not be prohibited from using our services under applicable laws or previous terms violations

Account Responsibilities and Security

As an account holder, you are responsible for:

  • Maintaining the confidentiality and security of your account credentials, including passwords and security questions
  • All activities that occur under your account, whether authorized by you or not
  • Immediately notifying us of any unauthorized use of your account or any other security breaches
  • Keeping your account information current, accurate, and complete at all times
  • Using strong, unique passwords and enabling two-factor authentication when available
  • Logging out of your account when using shared or public computers

Account Termination

We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or pose security risks to our platform or other users. You may also terminate your account at any time, subject to fulfilling any outstanding obligations.

4. Leasing Terms and Conditions

Leasing Agreements and Payment Terms

When you enter into a leasing agreement with KenkoWear Hub, the following terms apply:

  • Monthly lease payments are due on the same date each month as specified in your lease agreement
  • Late payments may incur additional fees as outlined in your specific lease agreement, typically 5% of the monthly payment after a 5-day grace period
  • You may upgrade to a newer device model at any time during the lease term, with adjusted monthly payments
  • You may purchase the leased device at any time by paying the remaining lease balance plus any applicable purchase fees
  • Early termination of lease agreements may result in fees as specified in your individual lease contract
  • Automatic renewal options are available for continued leasing at the end of the initial term

Device Care and Maintenance Responsibilities

As a lessee, you agree to:

  • Use the device in accordance with manufacturer guidelines and recommended practices
  • Maintain the device in good working condition through proper care and handling
  • Report any damage, malfunction, or defects immediately to our customer service team
  • Return the device in acceptable condition at the end of the lease term, subject to normal wear and tear
  • Purchase optional device protection plans for comprehensive coverage against accidental damage
  • Allow authorized technicians to perform necessary maintenance and repairs
  • Not attempt unauthorized repairs, modifications, or alterations to the device

Insurance and Protection Plans

We strongly recommend purchasing device protection plans that cover accidental damage, theft, and extended warranty coverage. These plans provide peace of mind and may reduce your financial liability for device damage or loss.

5. Purchase Terms and Payment Processing

Pricing and Payment Methods

All prices are listed in Japanese Yen (¥) and include applicable consumption tax unless otherwise stated. We accept the following payment methods:

  • Major credit cards including Visa, Mastercard, JCB, and American Express
  • Bank transfers through Japanese financial institutions
  • Digital payment services including PayPay, Line Pay, and Rakuten Pay
  • Corporate purchase orders for qualified business customers
  • Installment payment plans for eligible purchases over ¥50,000

Order Processing and Fulfillment

Orders are typically processed within 1-2 business days of payment confirmation. We reserve the right to:

  • Verify payment information and billing addresses before processing orders
  • Cancel orders due to pricing errors, inventory shortages, or payment issues
  • Limit quantities on certain products during high-demand periods
  • Refuse service to customers with previous payment or return issues
  • Require additional verification for high-value orders or new customers

6. Shipping, Delivery, and Risk of Loss

We provide shipping throughout Japan with the following terms and conditions:

  • Standard Delivery: 2-5 business days via Japan Post or Yamato Transport
  • Express Delivery: 1-2 business days with additional fees ranging from ¥500-¥1,500
  • Free Shipping: Available on orders over ¥10,000 to most locations in Japan
  • Signature Confirmation: Required for all orders over ¥30,000 and all leased devices
  • Risk of Loss: Transfers to the customer upon delivery confirmation and signature
  • Delivery Restrictions: Some remote areas may have extended delivery times or additional fees
  • Packaging: All items are securely packaged with appropriate protection for safe transport

7. Returns, Exchanges, and Refund Policy

Return Policy for Purchased Items

You may return purchased items within 14 days of delivery under the following conditions:

  • Items must be in original, unused condition with all original packaging, accessories, and documentation
  • No signs of wear, damage, or use beyond normal inspection and setup
  • Return authorization must be obtained through our customer service team before shipping
  • Original receipt or proof of purchase must be provided
  • Return shipping costs are the responsibility of the customer unless the return is due to our error
  • Refunds will be processed within 5-10 business days after we receive and inspect the returned item

Exchanges and Warranty Claims

Exchanges are available for the following situations:

  • Defective products within the manufacturer warranty period
  • Incorrect items shipped due to our fulfillment error
  • Size or color variations when available and in stock
  • Damaged items received due to shipping issues

Non-Returnable Items

Certain items cannot be returned for health and safety reasons, including items that have been personalized, customized, or show signs of use beyond normal inspection.

8. Warranties, Disclaimers, and Limitation of Liability

Product Warranties

We provide comprehensive warranty coverage for all products and services:

  • New Devices: Full manufacturer warranty as specified by the device manufacturer, typically 1-2 years
  • Certified Pre-owned Devices: 6-month KenkoWear Hub warranty covering defects and functionality issues
  • Repair Services: 90-day warranty on all parts and labor for repair services
  • Extended Protection Plans: Available for purchase to extend warranty coverage and add accidental damage protection

Service Disclaimers

While we strive to provide excellent service, our services are provided "as is" without warranties beyond those explicitly stated. We disclaim liability for:

  • Third-party application integrations, compatibility issues, or data synchronization problems
  • Accuracy of health and fitness data generated by devices or our analytics platform
  • Service interruptions due to technical issues, maintenance, or circumstances beyond our control
  • Indirect, consequential, or incidental damages arising from use of our services
  • Data loss or corruption not directly caused by our negligence

Limitation of Liability

To the maximum extent permitted by Japanese law, KenkoWear Hub's total liability for any claims is limited to the amount paid for the specific product or service giving rise to the claim, and in no event shall exceed ¥100,000 per incident.

9. Intellectual Property Rights

All content on our website, mobile applications, and marketing materials is protected by intellectual property laws. This includes but is not limited to:

  • Trademarks, service marks, and trade names including "KenkoWear Hub" and our logo
  • Copyrighted content including text, graphics, images, software, and user interfaces
  • Proprietary algorithms, analytics methods, and business processes
  • Product descriptions, specifications, and marketing materials

You may not copy, modify, distribute, sell, or create derivative works from our content without explicit written permission. Limited use for personal, non-commercial purposes is permitted under fair use principles.

10. User Conduct and Prohibited Activities

Users of our services agree not to engage in the following prohibited activities:

  • Violating any applicable laws, regulations, or third-party rights
  • Providing false, misleading, or fraudulent information during registration or transactions
  • Attempting to gain unauthorized access to our systems, other user accounts, or restricted areas
  • Interfering with or disrupting our services, servers, or networks
  • Using our services for illegal activities, including money laundering or fraud
  • Harassing, threatening, or abusing other users or our staff
  • Reverse engineering, decompiling, or attempting to extract source code from our software
  • Creating multiple accounts to circumvent restrictions or abuse our services

11. Account Termination and Suspension

We reserve the right to terminate or suspend your account and access to our services under the following circumstances:

  • Violation of these terms of service or our other policies
  • Fraudulent, illegal, or harmful activity
  • Non-payment of fees, charges, or outstanding balances
  • Abuse of our customer service team or other users
  • At our sole discretion with reasonable notice for business reasons

Upon termination, you must immediately return any leased devices and settle all outstanding balances. We may retain certain information as required by law or for legitimate business purposes.

12. Governing Law and Dispute Resolution

These terms are governed by the laws of Japan, and any disputes will be resolved according to Japanese legal procedures. Our preferred dispute resolution process includes:

  • Direct Negotiation: Good faith discussions between the parties as the first step in resolving disputes
  • Mediation: Use of recognized Japanese mediation services for disputes that cannot be resolved through negotiation
  • Arbitration: Binding arbitration through the Japan Commercial Arbitration Association for complex disputes
  • Court Proceedings: Litigation in the appropriate courts of Kanagawa Prefecture as a last resort

You agree to attempt resolution through these methods before pursuing legal action, and both parties agree to act in good faith throughout any dispute resolution process.

13. Changes to Terms of Service

We reserve the right to modify these terms at any time to reflect changes in our services, legal requirements, or business practices. Material changes will be communicated through:

  • Email notifications to all registered users at least 30 days before changes take effect
  • Prominent notices on our website homepage and relevant service pages
  • In-app notifications for mobile application users
  • Account dashboard notifications highlighting specific changes that may affect you

Your continued use of our services after the effective date of changes constitutes acceptance of the modified terms. If you disagree with changes, you may terminate your account before the changes take effect.
